An interesting knock on effect of the pardon will be that Hunter can no longer use his fifth amendment protection from self incrimination to avoid testifying against other members of the Biden family.

It will be interesting to see if this becomes an issue if he is called to testify in any investigations by the new administration and Congress.

I don't think the pardon can work WITHOUT a federal conviction. Since Hunter hasn't been federally convicted to Burisma related activities, that's still on the table. And that's assuming someone in Ukraine doesn't grow a pair and convict him there. And as such, he wouldn't lose his 5th amendment protections against those un-convicted crimes.

There is an easy way to test that. Call him in and start asking questions. Any topic where he asserts his fifth amendment right against self-incrimination is fair game for a prosecution. Put him on the horns of a dilemma as we say in the legal field.

As much as I'd like to think differently any chance of the Bidens seeing justice on this plane of existence vanished the moment he took office. Hunter's free and clear and knows it. It would just be "I don't recall" over and over. Does anyone seriously believe there won't be a stack of pardons for the rest around Jan 19? I'd bet they've been signed and ready since Jan 20, 2021.

Yeah, he can unfortunately. He is still liable for State charges. However if asked about bribery payments from Ukraine or China it would be hard to not answer on the 5th as those would not be State crimes.

This pardon is not just about protecting Hunter from legal consequences related to his prior convictions but also about safeguarding him from investigations into his controversial business dealings, most notably his tenure on the board of Burisma.

In other words; protection from prosecution from the Biden family criminal enterprise.

Biden’s 11-year blanket pardon of Hunter is even more expansive than the pardon Ford gave to Nixon in the aftermath of the Watergate scandal.

At the moment, I'm warm. Hot coffee inside and a fire going. This time of the year, the Sun doesn't crest the trees to the South of us, so until mid-January we get whatever manage to pierce the treeline.

It's perpetual gloom, unless the sky is entirely clear. Woke up to -11C/12F, and 4" of over-night snow. Work work work. Who needs a gym?

Speaking of AC - we have one of those air/air-fans installed but the power is too expensive to run it, and the manual states it's not to be used when it's below -15C.

It's funny in a way. Firewood to last us from October 1st until April 30th cost - if we buy it cut and split - us about $500. But since there was a brief storm a few weeks ago I was busy clearing trees from a nearby road, our actual cost this year will be about $30 for heating for the same period (petrol + oil for the chainsaw).

And that /really/ warms the heart of a skinflint!

That's the part that confuses me, actually. If the Justice Department were to take some prosecutorial action against Joe Biden, for acts committed between 2014 and the present (Joe was Vice President, then a private citizen and then President) then Hunter could be called to testify, and ostensibly could not plead the 5th.

Yes, the real purpose is to stop investigation of the Biden family influence peddling scheme. The easiest way to get more evidence would have been to make a deal with Hunter so he could testify against the rest of the family. The pardon makes that impossible, or at least very difficult.

That doesn't make sense. Pardoning Hunter takes away his ability to refuse to testify against others, as he cannot incriminate himself by giving testimony (no 5th Amendment ability to refuse to testify).

Hunter's sentencing for his tax crimes was to be in two to three weeks. He pleaded guilty because a trial might have opened up new avenues of investigation that could lead to Joe. Pardoning Hunter now gives the court time to remove that from the calendar.

The Fifth Amendment says you can refuse to testify on the grounds that it might tend to incriminate you. But now nothing can incriminate Hunter for that period (not on federal charges anyway), so he can no longer refuse to testify. It's quite a common thing. Common thugs are given immunity on some charge in order to force them to implicate others.

Civil suits decide torts, not crimes. The Fifth Amendment prevents you from inCRIMinating yourself, not financially inconveniencing yourself. Therefore it doesn't apply in civil cases.
